FANTECH “TRADE REWARD” OFFER
TERMS AND CONDITIONS
- Instructions on how to participate and the Reward (as defined below) form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
- This offer is open to businesses operating in Australia that are MMEM Group account customers (each an “Eligible Business”).
- Offer opens on 01/11/2025 and closes at 11:59pm AEDT on 31/03/2026 (“Offer Period”).
- “Eligible Products” are eligible Fantech Trade AC Ceiling Fans, DC Ceiling Fans and the Response Range products as listed in Annexure A below and that are sold through MMEM Group. This offer excludes Grilles and Ancillaries.
- This offer applies to Eligible Products purchased through MMEM Group branches only (“Profit Centres”).
REGISTRATION
- To be eligible to claim a Reward (as defined below), an authorised person on behalf of an Eligible Business (“Authorised Person”) must at any time during the Offer Period register the Eligible Business for the offer by completing the following steps during the Offer Period:
- Visit https://fantechtrade.com.au/cashback/;
- Locate the online registration form;
- Input all mandatory requested details, including their full name, address, phone number, email address and the Eligible Business’s MMEM Group Account Customer Number;
- Tick the boxes consenting to these Terms and Conditions, confirming that they are the owner of the Eligible Business (or an Authorised Person) and to receiving marketing materials from the Promoter; and then
- Submit the fully completed registration form.
- Only one (1) registration is permitted per Eligible Business.
- To participate in this offer, an Authorised Person must, on behalf of an Eligible Business, purchase Eligible Products from a Profit Centre using their MMEM Group Account during the Offer Period. The Promoter will allocate points (“Points”) to each Eligible Business for each Eligible Product purchased during the Offer Period. A full list of Eligible Products and associated Points is listed in Annexure A.
For clarity, Profit Centre managers or delegates may email Eligible Businesses throughout the Offer Period, encouraging them to register, if they are informed by head office that the Eligible Business has purchased Eligible Products but has failed to register in accordance with point 6 above. Further, Eligible Businesses that have registered, may also receive emails from Profit Centre managers or delegates with reminder emails throughout the Offer Period. An authorised Person on behalf of an Eligible Business can also email Fantech Trade for their latest points balance.
REWARD
- Points are accumulated for valid Eligible Products purchased during the Offer Period. At the end of the Offer Period – and provided an Eligible Business has (a) registered to participate in the offer in accordance with point 6 above; and (b) accumulated at least ten (10) Points – the Promoter will award each Eligible Business an Eftpos Gift Card with a value pre-loaded according to the total number of Points earned where 1 Point is equivalent to $1 (“Reward”). For example, if an Eligible Business earns a total of fifty (50) Points by the end of the Offer Period, the Promoter will award the Eligible Business a $50 Eftpos Gift Card. For clarity, an Eligible Business must accumulate at least ten (10) Points to receive a Reward.
- Rewards will be awarded to the Eligible Business regardless of who submitted the registration and/or who made the Eligible Product purchases.
REWARDS
- Rewards are subject to review and approval by the Promoter. Rewards will be issued once verified.
- Once purchases have been validated, Rewards will be either hand delivered to Eligible Businesses by the Promoter’s sales representatives or dispatched to the Eligible Business address as listed on the registration form.
- Any ancillary costs associated with redeeming the Reward are not included. Any unused balance of the Reward will not be awarded as cash. Redemption of a Reward is subject to the Eftpos Gift Card Product Terms and Conditions available at https://truerewards.com.au/igo-issuer-visa-gift-cards-terms/.
- The Promoter reserves the right, at any time, to verify the validity of Eligible Businesses (including their MMEM Group account details and purchase history) and reserves the right, in its sole discretion, to disqualify any Eligible Business who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the offer. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- Incomplete purchases of Eligible Products or purchases of Eligible Products that have been cancelled or returned will be deemed invalid. For clarity, if, during the Offer Period, and until a Reward is issued, any Eligible Product contributing towards a Reward, are returned for a refund or credit, or exchanged for a product or products that are not Eligible Products, the Promoter reserves the right in its absolute discretion to invalidate those purchases and adjust the Eligible Business’ Points (or reduce the Reward amount accordingly). Where an Eligible Business has acted in bad faith with the intention of returning Eligible Products after claiming a Reward, the Promoter reserves its rights to protect its legitimate business interests, including to invoice the Eligible Business for the reasonable costs incurred by the Promoter in respect of such conduct.
- If there is a dispute as to the identity of an Eligible Business, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Business.
- The Promoter’s decision is final and no correspondence will be entered into.
- If for any reason an Eligible Business does not take/redeem a Reward (or an element of the Reward) by the time stipulated by the Promoter, then the Reward (or that element of the Reward) will be forfeited.
- If any Reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the reward with a reward to the equal value and/or specification.
- Rewards, or any unused portion of a Reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- Authorised Persons on behalf of Eligible Businesses consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful Eligible Business (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this offer (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Business; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
- Any cost associated with accessing the promotional website is the Eligible Businesses responsibility and is dependent on the Internet service provider used.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business; or (f) use of a Reward.
- The Promoter may collect personal information (“PI“) in order to conduct the offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and reward suppliers. Participation in this offer is conditional on providing this PI. PI will be stored on the Promoter’s database. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its Privacy Policy which is located at https://fantechtrade.com.au/privacy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Authorised Representative or the Eligible Business. The Privacy Policy also contains information about how an Authorised Person on behalf of an Eligible Business may opt out, access, update or correct their PI, how these individuals may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
